These Terms of Service govern access to Cottage Kit and purchases made through cottagekit.us. “Cottage Kit,” “we,” “us,” and “our” refer to Austin Murn, doing business as Cottage Kit. By using the site or placing an order, you agree to these Terms and the policies linked on the site.

Store Use

You may use the site only for lawful personal or commercial shopping purposes. You must not misuse the site, interfere with its operation or security, introduce malicious code, scrape or copy protected content without permission, impersonate another person, or use the site in violation of law.

By placing an order, you confirm that you have legal capacity to enter into the transaction or have authorization from a parent or legal guardian where required.

Products and Information

We try to present accurate product descriptions, specifications, prices, availability, and images. Colors and appearance can vary by screen and production batch. We may correct errors, update information, limit quantities, discontinue products, or cancel an affected order. If we cancel a paid order, we will refund the canceled amount.

Product use is subject to the instructions, warnings, limitations, and laws applicable in the customer’s location. Customers are responsible for determining whether a product is suitable and legal for their intended use.

Orders

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt but does not guarantee acceptance or fulfillment. We may decline or cancel an order for reasons including suspected fraud, payment failure, pricing or listing errors, unavailable inventory, shipping restrictions, supplier failure, or legal requirements.

Customers must provide current, complete, and accurate billing, contact, and shipping information. Cancellation and address-change requests are governed by our Refund and Return Policy.

Prices, Payment, Duties, and Taxes

Prices are shown in the currency displayed at checkout and can change without notice before an order is submitted. The customer authorizes us and our payment providers to charge the total shown at checkout.

Taxes, shipping charges, duties, customs fees, brokerage fees, and other assessments may apply. International charges not expressly collected at checkout are the recipient’s responsibility.

Shipping, Returns, and Refunds

Our Shipping Policy and Refund and Return Policy are incorporated into these Terms. Delivery dates are estimates unless expressly stated otherwise. Nothing in these Terms limits non-waivable consumer rights.

Third-Party Services

The store is hosted by Shopify and may rely on payment processors, analytics providers, marketing tools, carriers, fulfillment platforms, and product suppliers. Those third parties may process information or provide services under their own terms and privacy practices. We are not responsible for third-party websites that are not controlled by Cottage Kit.

Intellectual Property

The Cottage Kit name, site design, original text, graphics, logos, and other original store content are owned by or licensed to Cottage Kit and are protected by applicable law. Product names, trademarks, and other third-party materials belong to their respective owners. No ownership rights are transferred by access to the site.

Disclaimers

To the maximum extent permitted by law, the site and products are provided on an “as available” basis. We do not guarantee that the site will always be uninterrupted, secure, or error-free. Product warranties and remedies are provided as stated in the applicable listing, our policies, and mandatory law.

Limitation of Liability

To the maximum extent permitted by law, Cottage Kit will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the site or products. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. These limitations do not apply where prohibited or to rights that cannot be waived.

Indemnification

To the extent permitted by law, you agree to indemnify Cottage Kit from third-party claims arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person’s rights.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Mandatory consumer protections and jurisdiction rights in the customer’s place of residence remain unaffected where they apply.

Changes and Severability

We may update these Terms by posting a revised version with a new “Last updated” date. Changes apply prospectively unless law requires otherwise. If any provision is held unenforceable, the remaining provisions continue in effect.
